Yes, you are confused. It is called utility right of way. They don't have to ask you for anything.  

However if you're unhappy with the results when they're done, be certain to contact AT&T and make a formal complaint both verbally and follow it up with a letter for what has happened and how unhappy you are about it, have photographs.  I didn't have photographs and the Boulevard in my front yard has sunk 3 inches since it was dug up in 2010 or so.  
Comcast came through in 2006 or 2007 and did the same thing, but the boulevard did not think when they were done.
