Apart from the FUD that has been flooding this list, does anyone have
any reasonable disagreements with the Real ID Act? Specifically I am
referring to H.R.418.RFS Title II (If you find a later draft, please
link me to it).
First, Sec. 202 stipulates minimum requirements for a State to be in
compliance. This bill/law does not REQUIRE a State to do ANYTHING. It
only requires it to meet these requirements if they wish it to be
used in FEDERAL transactions. Also, please look at Sec. 202
Subsection B. Is there any information required here that you
_really_ object to? Is there any information here which is not
already available through other public means?
Secondly, Sec. 203 does not REQUIRE States to participate in the
database information exchange. If your State wants a grant, they must
meet the requirements of Sec. 202 and participate as stipulated in
Sec. 203.
It is appropriate to note that Sec. 202, as concerned with the
acceptability of your State issued ID for Federal transaction, is
completely independent of Sec. 203. Your State need NOT participate
in the sharing of data with other States in order for your license to
be accept. It only participates if it wishes to receive funding.
So... What is everyone getting their panties in a knot about?
